INZI TRAVEL LLC – TERMS AND CONDITIONS

Welcome to INZI Travel LLC (“we,” “us,” or “our”). These Terms and Conditions (“Agreement”) govern your access to and use of our services, including but not limited to booking travel-related services, accessing our website at www.inzitravel.com, and interacting with our authorized representatives. By accessing, using, or booking through our services, you (“Customer,” “you,” or “your”) agree to comply with and be bound by this Agreement. If you do not agree to these terms, you must immediately discontinue use of our services.

  1. Scope of Services

1.1 Service Description

INZI Travel LLC provides a wide range of travel-related services tailored to meet the needs of our Customers, including but not limited to:

  • Planning and coordinating individual and group travel itineraries,
  • Booking flights, accommodations, and transportation services,
  • Organizing guided tours, curated travel experiences, and exclusive group packages, and
  • Facilitating additional travel-related activities as requested by the Customer.

1.2 Intermediary Role

  • INZI Travel LLC operates as an intermediary between the Customer and third-party service providers, including but not limited to airlines, hotels, rental car agencies, tour operators, and activity organizers (“Third-Party Providers”).
  • INZI Travel LLC does not own, manage, or control these Third-Party Providers and therefore cannot guarantee the quality, availability, or performance of the services they provide.
  • All bookings facilitated by INZI Travel LLC are subject to the terms, conditions, and limitations imposed by the respective Third-Party Providers. Customers are advised to review these terms carefully before completing their bookings.

1.3 Customer Responsibility

  • Customers are responsible for providing accurate and complete information during the booking process, including but not limited to:
    • Full name (as it appears on government-issued identification),
    • Contact details (email, phone number, etc.),
    • Travel dates and preferences, and
    • Any special requests or requirements, such as dietary restrictions or accessibility needs.
  • INZI Travel LLC assumes no liability for delays, cancellations, or additional costs arising from incorrect, incomplete, or omitted information provided by the Customer.
  1. Booking and Payment Terms

2.1 Booking Process

  • All bookings must be initiated through INZI Travel LLC’s website (www.inzitravel.com) or through communication with our authorized representatives.
  • Bookings are considered tentative until full payment is received and confirmation is provided by the relevant Third-Party Provider.
  • Upon confirmation of a booking, Customers will receive a detailed itinerary and booking confirmation email outlining the travel arrangements.

2.2 Payment Platform

  • Payments for bookings are securely processed through Stripe, a trusted third-party payment processor. By providing your payment information, you agree to Stripe’s terms and conditions in addition to this Agreement.
  • INZI Travel LLC does not store full payment card details on its systems and relies on the encryption and security measures provided by Stripe to protect Customer data.

2.3 Use of Credit Card

  • Payments collected from Customers are processed by INZI Travel LLC, which will use its business credit card facilities or accounts to fulfill bookings with Third-Party Providers.
  • Customers acknowledge and agree that all payments are made directly to INZI Travel LLC, not to the Third-Party Providers. INZI Travel LLC acts as the payment intermediary for securing services on behalf of the Customer.

2.4 Additional Charges and Fees

  • Certain bookings may incur additional charges, including but not limited to:
    • Taxes,
    • Service fees,
    • Change fees for modifications requested by the Customer, and
    • Mandatory charges imposed by Third-Party Providers (e.g., resort fees).
  • Any applicable fees will be disclosed to the Customer prior to booking confirmation.

2.5 Credit Card Fees, Chargebacks, and Reversals

  • Customers are responsible for any processing fees incurred due to chargebacks, reversals, or disputes initiated by the Customer with their payment provider.
  • INZI Travel LLC reserves the right to dispute any unwarranted chargebacks and to recover the full booking cost from the Customer if the dispute is resolved in favor of INZI Travel LLC.

Additional Provisions

2.6 Special Requests

  • INZI Travel LLC will make every effort to accommodate special requests made by the Customer, such as seat preferences, room upgrades, or specific travel arrangements. However, these requests are not guaranteed and are subject to availability at the discretion of Third-Party Providers.

2.7 Currency and Payment Methods

  • All prices are quoted in U.S. Dollars (USD) unless otherwise stated.
  • Payments must be made using approved payment methods, including major credit cards or alternative methods accepted by Stripe.

2.8 Fraud Prevention

  • INZI Travel LLC reserves the right to cancel bookings or suspend accounts if fraudulent activity is suspected, including but not limited to unauthorized payment methods or falsified Customer information.
  1. Cancellations, Refunds, and Modifications

3.1 Third-Party Provider Policies

  • Cancellations, modifications, and refunds for bookings facilitated by INZI Travel LLC are governed by the terms and conditions of the respective Third-Party Providers, such as airlines, hotels, and tour operators.
  • Non-refundable or partially refundable bookings will be clearly communicated to the Customer at the time of booking. INZI Travel LLC will not issue refunds for bookings explicitly marked as non-refundable.

3.2 Customer-Initiated Cancellations

  • Individual Travel Bookings:
    • Customers must submit cancellation requests in writing to vacations@inzitravel.com.
    • Cancellation requests will be processed in accordance with the terms of the relevant Third-Party Providers. INZI Travel LLC will facilitate communication between the Customer and the providers but cannot guarantee refunds outside their policies.
  • Group Travel Bookings:
    • For group travel packages, cancellations made 30 or more days prior to the scheduled travel date may qualify for a refund, less a $50 administrative fee per traveler.
    • Cancellations made within 30 days of the scheduled travel date are non-refundable unless explicitly stated otherwise in the booking terms.
  • No-Show Policy:
    • Customers who fail to appear for their scheduled travel without prior cancellation are not eligible for a refund.

3.3 Force Majeure Events

  • INZI Travel LLC shall not be held liable for cancellations, delays, or modifications resulting from circumstances beyond its reasonable control, including but not limited to:
    • Natural disasters (e.g., earthquakes, hurricanes),
    • Pandemics or public health emergencies,
    • Acts of terrorism or war,
    • Strikes, labor disputes, or civil unrest, and
    • Government-imposed travel restrictions or bans.
  • Refunds or credits for services affected by force majeure events are subject to the discretion and policies of the Third-Party Providers. INZI Travel LLC will assist Customers in negotiating such refunds or credits but cannot guarantee the outcome.
  1. Liability and Disclaimers

4.1 Limitation of Liability

To the fullest extent permitted by applicable law:

  • INZI Travel LLC is not liable for:
    • Personal injury, illness, or death incurred during travel,
    • Property damage, loss, or theft, or
    • Financial losses or inconveniences caused by delays, cancellations, or errors on the part of Third-Party Providers.
  • INZI Travel LLC’s total liability for any claims arising under this Agreement is strictly limited to the amount paid directly to INZI Travel LLC by the Customer for the relevant booking.

4.2 Indemnification

  • By using INZI Travel LLC’s services, the Customer agrees to indemnify, defend, and hold harmless INZI Travel LLC, its officers, employees, agents, and affiliates from any claims, damages, or losses arising out of:
    • The Customer’s breach of this Agreement, and
    • Issues, disputes, or damages related to services provided by Third-Party Providers.

4.3 Travel Insurance

  • INZI Travel LLC strongly encourages Customers to purchase comprehensive travel insurance to cover potential risks, including:
    • Trip cancellations or interruptions,
    • Medical emergencies or evacuation,
    • Lost, stolen, or damaged baggage, and
    • Travel delays or disruptions.
  • Customers are solely responsible for obtaining and reviewing travel insurance coverage. INZI Travel LLC assumes no liability for risks that could have been mitigated through insurance.
  1. Privacy and Data Protection

5.1 Data Collection and Use

  • By booking travel services with INZI Travel LLC, Customers consent to the collection, use, and processing of their personal data, which may include:
    • Names,
    • Contact information (e.g., email address, phone number),
    • Payment details (processed securely via Stripe), and
    • Travel preferences or special requests.
  • Personal data is collected and processed solely for the purpose of facilitating travel arrangements, enhancing service delivery, and complying with legal and regulatory obligations.

5.2 Sharing of Data

  • Customer data will be shared only with Third-Party Providers as necessary to complete bookings and provide requested services. This may include:
    • Airlines, hotels, and car rental agencies,
    • Tour operators, and
    • Any other service providers involved in fulfilling the Customer’s travel itinerary.
  • INZI Travel LLC does not sell, lease, or disclose Customer information to unauthorized third parties for marketing or other purposes without explicit consent.

5.3 Data Security

  • INZI Travel LLC employs industry-standard encryption, firewalls, and security protocols to protect Customer data from unauthorized access, alteration, or disclosure.
  • All payment information is processed securely through PCI-compliant payment processors (e.g., Stripe). INZI Travel LLC does not store full payment card details on its servers.
  1. Governing Law and Dispute Resolution

6.1 Applicable Law

  • This Agreement, including its interpretation, execution, and enforcement, shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.

6.2 Dispute Resolution

  • Any disputes, claims, or controversies arising out of or relating to this Agreement, including but not limited to the use of INZI Travel LLC’s services or any breach thereof, shall be resolved exclusively in the state or federal courts located in Broward County, Florida.
  • By using our services, you consent to the personal jurisdiction of these courts and waive any objections based on venue or inconvenient forum.

6.3 Attorney’s Fees and Costs

  • In any legal action or proceeding arising out of or relating to this Agreement, the prevailing party shall be entitled to recover its reasonable attorney’s fees, court costs, and other related expenses incurred in enforcing its rights under this Agreement.

6.4 Alternative Dispute Resolution (Optional)

  • INZI Travel LLC reserves the right to propose mediation or arbitration as a form of alternative dispute resolution. If agreed upon by both parties, such proceedings will take place in accordance with the rules of the American Arbitration Association (AAA) and will occur in Broward County, Florida.
  1. Amendments and Termination

7.1 Amendments

  • INZI Travel LLC reserves the right to amend, revise, or update these Terms and Conditions at any time without prior notice.
  • Changes to the Agreement will become effective immediately upon their publication on the INZI Travel LLC website (www.inzitravel.com).
  • Continued use of our services following the posting of amendments constitutes acceptance of the revised Terms and Conditions.

7.2 Termination of Services

  • INZI Travel LLC reserves the right to suspend or terminate your access to its services without notice if:
    • You violate any provision of this Agreement,
    • You engage in fraudulent, abusive, or unlawful activity, or
    • You misuse the platform or services in a manner that disrupts operations or harms other users.
  • Upon termination:
    • All rights granted to you under this Agreement will immediately cease.
    • You remain responsible for any outstanding obligations, including payment for bookings or services provided prior to termination.

7.3 Effect of Termination

  • Termination of this Agreement shall not affect any rights, remedies, obligations, or liabilities that accrued prior to termination, including any obligations to indemnify or pay fees under the terms herein.
